CastingNow – Terms and Conditions

IMPORTANT – READ CAREFULLY: By downloading, installing or using the CastingNow mobile application (“App”) you (“you”, “your” or “User”) agree to be bound by these Terms and Conditions (“Terms”). If not, please do not open the App.

  1. About this App

The App enables users to cast audio and visual content from their mobile devices to compatible smart-TVs, streaming sticks, set-top boxes and other receivers (“Receivers”) over a local Wi-Fi network or the internet.

  1. Acceptance of Terms

By creating an account, tapping “Accept”, or otherwise using the App, you confirm that you:

(a) are at least 16 years old (or the age of majority where you live);

(b) have full power and authority to enter into these Terms; and

(c) accept these Terms and our Privacy Policy, which is incorporated herein by reference.

  1. Account Registration & Security

3.1 You may access some features without an account, but full functionality requires registration.

3.2 You must provide accurate information and keep it updated.

3.3 You are responsible for safeguarding your credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.

  1. Licenses

4.1 App License: Subject to these Terms, CastingNow grants you a limited, non-exclusive, non-transferable, revocable license to install and use one copy of the App on mobile devices that you own or control.

4.2 Content License: The App allows you to cast content that you lawfully own or have the right to stream. CastingNow does not host, store or control such content. You retain all rights in content you own and grant CastingNow only the limited rights necessary to facilitate casting.

  1. Prohibited Conduct

You agree NOT to:

  1. a) use the App for any unlawful, harmful, obscene or infringing purpose;
  1. b) reverse-engineer, decompile, disassemble or attempt to discover source code;
  1. c) interfere with or disrupt the App, Receivers or related servers/networks;
  1. d) circumvent digital rights management, content-protection or security measures;
  1. e) collect or store personal data about other users without consent;
  1. f) rent, lease, sublicense or commercially exploit the App without written permission.
  1. Third-Party Services & Content

6.1 The App may integrate with YouTube, Netflix, Spotify, web browsers and other third-party services. Your use of such services is subject to their own terms and privacy policies. CastingNow is not responsible for third-party content, availability or policies.

6.2 Some Receivers may display advertisements supplied by third parties; CastingNow does not control or endorse those ads.

  1. Ownership

The App, including all software, trademarks, logos and intellectual property, is owned by CastingNow or its licensors and is protected by copyright, trade-secret and other laws. Except for the limited license in Section 4, no rights are granted to you.

  1. Payments & Subscriptions

8.1 CastingNow may offer a free tier and optional paid subscriptions. Fees are disclosed on the front page.

8.2 Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current period through your platform account (Apple App Store / Google Play).

8.3 All fees are non-refundable except as required by applicable law or the refund policies of the platform provider.

  1. Privacy

Our Privacy Policy explains how we collect, use and share your data. By using the App you consent to such practices.

  1. Termination

We may suspend or terminate your account or access whenever it is necessary for breach of these Terms, suspected fraud, or if required by law. Upon termination, Sections 5, 7, 11-15 survive.

  1. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASTNOW DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE. WE DO NOT WARRANT UNINTERRUPTED, ERROR-FREE OR SECURE OPERATION, NOR THAT CONTENT CASTED WILL BE FREE FROM LOSS, CORRUPTION, ATTACK, VIRUSES, INTERFERENCE, HACKING OR OTHER SECURITY INTRUSION.

  1. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASTNOW, ITS AFFILIATES, OFFICERS, EMPLOYEES OR AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA OR GOODWILL, ARISING OUT OF OR RELATED TO THE APP EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE GREATER OF USD $50 OR THE AMOUNT YOU PAID CASTNOW IN THE LAST 12 MONTHS.

  1. Indemnification

You agree to defend, indemnify and hold harmless CastingNow from and against all claims, damages, obligations, losses, liabilities, costs and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the App; (b) your violation of these Terms; or (c) your violation of any third-party rights, including intellectual property or privacy rights.

  1. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. Any dispute arising under these Terms will be resolved exclusively in the state or federal courts located in Wilmington, Delaware, and you consent to personal jurisdiction therein. If you are an EU consumer, you may have additional rights to invoke local consumer-protection laws and forums.

  1. Changes to Terms

We may modify these Terms whenever it is necessary. We will notify you via the App or email at least 30 days before material changes take effect. Continued use after the effective date constitutes acceptance of the revised Terms.

  1. Severability & Entire Agreement

If any provision is held invalid, the remaining provisions remain in full force. These Terms constitute the entire agreement between you and CastingNow regarding the App and supersede all prior agreements.
